Terms & Conditions - BIKE TOUR

1) What is Bicycle Rome?

1.1 It is an Italian company "Bgp noleggio srl" based in via vittore carpaccio 60 - 00147 Roma, VAT number 17405641006; Bicycle Roma service offers guided urban and suburban bike tours in the cities of Rome and the Castelli Romani through itineraries of historical-artistic-cultural-natural interest predetermined according to cyclability.

2) Who can use the service?

2.1. Access to the service is granted upon presentation of the reservation voucher. The user authorized to ride shall comply with all identification and qualification formalities: required by Bicycle Roma. The user agrees not to provide false information and false identity.

2.2. The service is reserved for those over the age of 18 who can guarantee perfect driving in a city setting.

2.3. The service is also accessible to minors accompanied by an adult who assumes full responsibility for any damage caused to third parties by the minor or suffered by the minor. A person under the age of 14 is expressly required to wear a helmet.

2.4. Bicycle Roma reserves the right to deny access to the service to persons deemed unfit to drive the vehicle for any reason whatsoever and, in any case, at its sole discretion.

2.5. The use of the bicycle requires the physical and intellectual fitness as well as technical competence of the person who intends to ride it. Therefore, by taking delivery of the vehicle, the user declares that he or she is equipped with adequate skills and appropriate competence, without placing any reservations.

2.6. Users should wear clothing and footwear suitable for the use and driving of the vehicle.

3) Are you coming to access the service?

3.1. The service can be booked and purchased on the site www.bicycleroma.com or through the sites of OTA Online Travel Agencies.

3.2. The minimum number of participants is 2. If this threshold is not met, the user may reschedule the tour or obtain reimbursement of expenses incurred.

3.3. At the end of the reservation, the user will receive a voucher with the tour time and return point and any other useful information for the use of the service.

3.4. The tour starts and ends at the meeting point indicated on the voucher.

3.5. The reservation has a free cancellation policy up to 24 hours before the departure date and time of the booked tour. The Tour will not be cancelled in case of adverse weather conditions (see 4.5 below). Therefore, in such situations, no refund will be given, nor will there be any change of reservation.

4) Conditions for using the service

4.1. The user must be at the meeting point indicated on the voucher at least 10 minutes before the time indicated on the voucher in order to check in and pay for the tour, if any, if only a reservation was made through the

4.2. The user and Bicycle Roma (or their designee) will check, upon delivery of the vehicle, the state of functionality and accessories. The designated Guide will assist users in adjusting the seat, handlebars, and tire pressure of the bike. The Guide will point out to users any permissible and minor defects that are due to normal wear and tear of the vehicle and its accessories and do not constitute a danger to riding.

4.3. The vehicle thus adjusted is taken over by the user who recognizes it as mechanically efficient.

4.4. The user shall promptly notify the Guide of any failure of the vehicle or its accessories.

4.5. The Bike Tour will not be cancelled in case of rain. In case of light to moderate rain, the bike will provide each user with a raincoat. In case of heavy rain, the designated guide will accompany users on a walking tour

4.6. The user is expected to observe the utmost care in the use of the vehicle and its accessories

4.7. The user who has taken delivery of the vehicle is obliged to return it together with the accessories in the same condition.

4.8. Upon return of the vehicle and its accessories, Bicycle Roma reserves the right to ascertain any damage and/or malfunction caused by the user.

5) How to use the service?

5.1. Each excursion is preceded by an introduction on the main rules to be observed by the Designated Guide.

5.2. The main rules to be observed are as follows: ride single file not side by side, do not ride parallel to the streetcar tracks, get off the bike and ride hand in areas where riding is not allowed or when crossing roads challenging intersections or otherwise whenever indicated by the guide, turning on the lights provided when lighting conditions require it.

5.3. The user is obliged, in any case, to respect the rules provided by the Highway Code, which he declares to know. Bicycle Roma declines any responsibility in case of improper use of the vehicle by the user.

5.4. The user is also required to observe the rules of common sense and diligence in using and driving the vehicle.

5.5 By reserving a place on a tour, tour participants acknowledge that they are in adequate physical and mental condition to perform the activities described herein, Bicycle Roma is not responsible for any physical or mental problems evidenced during a tour.

5.6. The designated guide has the authority to request the removal of any person who fails to comply with the above rules and/or who endangers his or her own safety or that of other users.

5.7. The tour includes a specific number of stops. Unless exceptions are agreed upon with the Designated Guide and with the consent of all participants, there is no access to places of interest, in any case, the payment of any entrance fees, unless expressly stated, not included in the purchase price of the tour and, therefore, will be the responsibility of the users.

5.8. There is a break of about 15 minutes that can be used for a quick snack at the user's expense or as a rest break. The consumption of alcoholic beverages is strictly prohibited during the break. The custody of vehicles during the break period is carried out by the Designated Guide.

5.9. Departure from the group, strictly on foot, is allowed only during the scheduled stop. Leaving the group for any reason at times other than the scheduled stop is strictly prohibited.

5.10 In general, it is forbidden, except in cases of force majeure, to leave the tour before its completion. Therefore, the user is required to complete the tour even if the tour continues up to 45 minutes longer than the scheduled time.

5.11. Photographs may be taken during the course for informational, popular and promotional purposes. purposes. The consent of the person immortalized to the dissemination, publication or disclosure of the above-mentioned material shall be given with the delivery of a separate release. It is understood that photographic material detrimental to the dignity or worthiness of the persons concerned will not be processed and will be immediately deleted. 6) Liability for damages

6.1. During the guided tour, the user is responsible for any event or damage caused to himself, to third parties and to property, resulting from the use of the vehicle or accessories. No form of compensation may be claimed from Bicycle Roma.

6.2. In case of damages caused by the user to the vehicle or accessories (excluding punctures) not attributable to the normal use of the same, Bicycle Roma reserves the right to quantify and request reimbursement.

6.3. In case of theft, failure to return or irreparable damage to the vehicle, the user shall compensate for the damage based on the list prices of the vehicle or components

6.4 Bicycle Roma is not responsible for damage to user property or loss and theft of property suffered by users during the tour

7) Expertise

7.1 Disputes arising from these General Terms and Conditions will be governed by Italian law.

7.2. The place of jurisdiction shall be Rome.

Terms & Conditions - RENTAL

1) The User declares to return the bicycle and all rented equipment in perfect condition and maintenance. Any damage must be reported by the end of the rental to Bicycle Roma.

2) In order to obtain the bicycle rental, the user must show a valid photo identification document e.g. passport, in addition to making the required payment, and also a security deposit of €400 in cash or by pre-authorization as a guarantee, of a valid credit card of the holder of the said contract.

3) The activities involved in the active trips and tours described in our printed materials and on our website are physically demanding, strenuous, and potentially dangerous. By booking a place on a tour, tour participants acknowledge that they are in adequate physical and mental condition to perform the activities described herein. At the discretion of Bicycle Roma Tours employees, participants who do not meet these physical and mental requirements, or participants deemed harmful or disruptive to the enjoyment of the tour by other participants, may be asked to leave the tour, with no refund applicable. In the case of use by minors with the delivery of this contract, the parent/guardian or guardian of the minor assumes all responsibilities outlined in this contract and by the Civil Code, and accordingly authorizes the minor to use the bicycle under the conditions set forth in these regulations.

4) The bicycle is to be used exclusively as a means of transportation and must be treated with care, common sense and diligence in order to avoid damage to both the bicycle and its accessories. It is forbidden to use the bicycle for carrying out commercial activities, and it is possible to give it up for use to other parties.

5) The user is responsible for the bicycle until it is returned to the Management; he/she is also responsible for any damage caused to himself/herself, the bicycle, third parties and/and property while using the vehicle. No form of compensation may be claimed from the Management

6) The User is required to comply with the rules of the Highway Code. The Management disclaims any form of liability in case of misuse of the vehicle or non-compliance with the rules of the Highway Code.

7) The Management may conduct checks on Users while using bicycles and may require their return if it recognizes conditions of improper use of the bicycle. The Manager may refuse the rental of persons in a state of intoxication or under the influence of drugs (pursuant to Articles 186-187 of the Highway Code) and for other reasons at the sole discretion of the Management.

8) In the event of loss of keys, bicycle accessories, or due to damage, the Management will request from the customer the sums necessary for the original restoration of the bicycle, according to what is stated in this contract or, in the absence of the price list, in the supplier's estimate.

9) The bicycle must be returned, within the time specified in this contract, at the same place where it was rented. The bicycle will be considered returned only if it is returned directly to the Bike Point with countersignature of the return on the contract; Bicycles parked outside the rental point will not be considered returned during closing hours. Failure to return the bicycle without prior notice or otherwise not motivated by exceptional cases will be considered a theft offense and therefore reported to the Judicial Authority.

10) In the event of a puncture, Management is not required to intervene, so failure to intervene cannot constitute cause for breach of contract. Management is only required to intervene in case of a puncture if the User has purchased Bicycle Rescue Puncture Coverage (extra cost of €12). This can also occur after the start of the rental, so the customer will receive puncture assistance after payment of the fee.

11) The User must make the appropriate payment before the start of the rental, any damages will be redeemed at the official Bike Point or at the contracted facility.

12) The lessee declares that he/she is not suffering from any disorder or disease incompatible with the use of the leased property and that he/she is in good health. The lessor company is released from any liability with respect to false or untrue statements made by the lessee about his or her state of health.

13) If the bicycle is stolen, the User shall immediately notify Management at one of the contacts on the site www.bicycleroma.com

14) Bicycle Roma provides the renter with the option of taking out a third party liability insurance policy valid during the rental period. The said policy has a deductible of € 500.00.

15) The User who rents one or more bicycles for several days is obliged to use the rented goods in closed and safe places, such as hotels, b&b, etc. In case of theft or damage, he/she is solely responsible to the Management for any damage caused to the bicycles. For anything not mentioned in these regulations, the relationship between the parties (contractors) is governed by the rules of the Civil Code. For any disputes that may arise between the Parties, the place of jurisdiction is Rome.

16) Cancellation Policy

Free cancellation up to 24 hours before the start of the experience (Rental or Tour): refund of 100%.

No refund within 24 hours of experience: refund 0%.

17) Check the condition of the bicycle before use (brakes, wheels, etc.). Bicycle Roma during use is not responsible for your incorrect and careless use. If you encounter any problems you are required to notify, before departure, the Bicycle Roma staff who will intervene to replace the vehicle or solve the problem ascertained.

18) Check the battery level of the electric bicycle provided. Please note that it is not a scooter, if the battery is charged you have a MINIMUM range of 40km, NO REFUND CLAIMS WILL BE CONSIDERED IF YOU RETURN BEFORE THE RENTAL ESTABLISHED, UNLESS PROBLEMS WITH THE BATTERY ITSELF ARE DISCOVERED.

19) Bicycle Roma is not responsible for damage done to your clothing, you are solely responsible as you are required to check for any problems prior to rental.

20) In the event of an accident Bicycle Roma is not responsible for damages caused by e/a person or property. For a worry-free experience we strongly recommend purchasing insurance during the rental phase. Therefore, the customer will not be able to claim a bicycle and any kind of compensation.
